The process of obtaining a Modification to Building Permit follows the same procedural pattern as the Final Design Approval (FDA) and Final Building Permit (FBP). This means that the Developer must submit revised or modified drawings for review and approval by the EACML’s Development Control Department. The modification request is assessed in terms of architectural, structural, and MEP (Mechanical, Electrical, and Plumbing) changes, as well as compliance with earlier peer review recommendations and relevant city codes.

The approval for modification attracts a fee calculated pro-rata to the scope of modification—reflecting the scale and complexity of changes being introduced. The modification also requires submission of all relevant technical documentation, consultant certifications, and a peer-reviewed evaluation to validate compliance. This structured approach provides EACML with oversight while allowing Developers the flexibility to responsibly adapt their projects within approved regulatory frameworks.

Compulsory Requirements

To apply for a Modification to Building Permit (MBP), the Developer must submit the following documents and fulfill these conditions:

  1. Modified Design Development Drawings
    • Updated Architectural, Structural, and MEP drawings, stamped and signed by the appointed Consultants or Designers.
  2. Peer Review of Modified Drawings
    • Independent review confirming that the modified design remains compliant with structural stability, fire safety, and MEP standards.
  3. Final Building Permit (FBP)
    • A copy of the existing approved Final Building Permit related to the original project.
  4. Application Form (Appendix AA)
    • Completed “Request for Modification to Building Permit” form, signed by the Developer, with certification that all submitted information is accurate and authentic.
  5. Applicable Fees
    • Payment of a fee calculated pro-rata to the extent of modification (as defined in Chapter 13, Section 13.4).
  6. Consultant’s Endorsement
    • Confirmation and professional endorsement from the Supervising Consultants responsible for design and construction oversight.
  7. EACML Review and Approval
    • EACML conducts a review process similar to FDA/FBP evaluation. Upon approval, an official Modification to Building Permit is issued (refer to Appendix BB).
